-2- <br />PROPOSED DECISION <br />Salt Creek Mining Company <br />Munger Canyon Mine <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />stipulations, an application for a permit to conduct coal mining submitted <br />by Salt Creek Mining Company for the Munger Canyon Mine. <br />This approval decision is based on a finding that the proposed operation <br />will comply with all requirements of the Colorado Surface Coal Mining <br />Reclamation Act, C.R.S. 1973, as amended, 34-33-101 et seq., and the <br />Regulations promulgated pursuant to the Act. <br />The permit application and the stipulations will become a binding part of <br />the permit upon approval. The stipulations for the Munger Canyon Mine are <br />as follows: <br />Stipulation No. I <br />SIX MONTHS PRIOR TO THE DRIVING OF ROCK SLOPES WITHIN THE HUNGER <br />CANYON MINE FROM THE CAMEO COAL SEAM TO THE UPPER CARBONERA COAL <br />SEAM, THE APPLICANT h1UST SUBMIT GEOCHEMICAL AND PHYSICAL ANALYSES <br />OF THE UPPER CARBONERA ROOF AND FLOOR STRATA AND ALL INTERBURDEN <br />STRATA BETWEEN THE CAMEO AND UPPER CARBONERA COAL SEAMS WHICH WILL <br />BE ENCOUNTERED IN THE ROCK SLOPES. <br />Stipulation No. 2 <br />WITHIN SIX MONTHS OF PERMIT ISSUANCE AND PRIOR TO CONSTRUCTION OF <br />THE SEDIMENT PONDS AT THE MINE BENCH AND AT THE WASTE DISPOSAL SITE, <br />THE PERMITTEE MUST INSTALL APPROVED DEWATERING DEVICES TO DEWATER <br />THE PONDS TO THE MAXIMUM SEDIMENT STORAGE LEVEL. ALSO, THE <br />PERMITTEE MUST COMdfIT TO INSTALLING MARKERS TO INDICATE THE 60$ <br />SEDIMENT STORAGE LEVEL AT BOTH SEDIMENT PONDS. <br />Stipulation No. 3 <br />THE PERMITTEE MUST SUBMIT TO THE REGULATORY AUTHORITY AN ANNUAL <br />REPORT CHARACTERIZING THE INFLO475, DISCHARGES AND THE CONSUMPTION <br />OF WATER WITHIN THE I4INE. THIS REPORT IS TO INCLUDE A CURRENT MINE <br />WORKINGS MAP SHOWING THE LOCATION AND QUANTITY OF INFLOWS: A <br />TABLE KEYED TO THE MINE MAP WHICH SHALL CONTAIN THE SOURCE (i.e., <br />FAULTS, FRACTURES, ETC.), QUANTITY, DURATION, AND QUALITY (i.e., pH, <br />ELECTRO-CONDUCTIVITY AND TEMPERATURE) OF ALL NON-SEEP INFLOWS; A <br />TABLE CONTAINING RECORDS OF WATER DISCHARGED FROM THE MINE, CONSUI9ED <br />IN THE MINE AND IMPORTED FOR USE WITHIN THE MINE; A DISCUSSION OF <br />THE WATER BALANCE WITHIN THE MINE; AND, A PROJECTION OF HYDROLOGIC <br />IMPACTS OF MINING IN THE UPCObfING YEAR. <br />
