<br />SECTION B <br /> <br />The following findings and specific approvals are required by Rule 4: <br />I. Roads - Rule 4.03 <br />A. Haul Roads <br />1. The Division approves the retention of the haul road depicted <br />on Map No. 12 since it is compatible with the approved <br />post-mining land use, and a request for its retention was <br />submitted by the landowner (4.03.1(1)(f)(i)). <br />2. The Division approves the alteration or relocation of a natural <br />channel drainageway located in Starkville Gulch. The applicant <br />has successfully demonstrated that the natural channel drainage <br />will not be blocked, no significant damage will occur to the <br />hydrological balance, and no adverse impacts will occur to <br />adjoining landowners (4.03.1(4)(a)(i)). <br />8. Access Roads <br />1. The landowner has requested the retention of the access road <br />depicted on Map No. 12. It's retention is compatible with the <br />approved post mining land use of Rangeland. Therefore the <br />Division approves retention of the access road (4.03.2(1>(f)). <br />C. Light-Use Roads <br />1. No light-use roads will be retained. <br />II. Support Facilities - Rule 4.04 <br />A. No specific approvals have been granted. <br />III. Hydrologic Balance - Rule 4.05 <br />A. Water quality standards and effluent limitations <br />1. No specific approvals have been granted. <br />B. Diversions and Conveyance of Overland Flow <br />1. No specific approvals have been granted. <br />C. Stream Channel Diversions <br />1. The Division approves the diversion of an intermittent stream. <br />This decision is based on a finding that the proposed diversion <br />meets the requirements of 4.05.18 and 4.05.4, applicable local, <br />State, and Federal statutes and regulations and that the <br />diversion is designed to safeguard public safety and to <br />minimize adverse impacts to the hydrologic balance <br />(4.05.4(1) and (4)). <br />
