Following revocation of the permit in April 1993, TBM ceased <br />maintenance of the drainage control structures that conveyed flow to pond 15-P2. The <br />drainage control structures have failed at the bridge crossing of Del Agua Creek. The <br />uncontrolled flows threaten to wash out the bridge. The Division proposes to realign the <br />natural drainage channel to discharge flow downstream of the bridge. The old mine haul <br />road that provides access to the southeast side of the permit area will cross the realigned <br />stream channel by a graveled swale; access to the southeast side of the permit area will not <br />be impaired by the realignment plan. The Division finds the reconstruction of this natural <br />drainage to be the highest priority of all reclamation items remaining at the mine site. <br />Thank you for your cooperation. If the Division does not receive your response to this letter by <br />February 13, 1994, the Division will assume your consent and proceed with the plan as described <br />herein.
