Emergency spillways <br />have been provided, at least 1.0 feet above the crest of the princi- <br />pal spillways, to safely pass the peak flow rate from the 25-year, <br />24-hour storm event. The emergency spillways are located so that no <br />flow will be passed through the spillway during a 10-year, 24-hour <br />storm event. <br />(4) All supporting calculations, documents and drawings used to <br />establish the requirements of 4.05.6(3} above shall be included in <br />the permit application. <br />Response: All supporting materials used to comply with this Rule <br />are contained in Exhibit 3a, Sediment Control Plan. <br />(5) Any person who intends to impound water for a beneficial use <br />for surface coal mining operations shall meet all applicable State <br />laws. <br />Bespons e: IInder the proposed designs, the only water to be im- <br />pounded will be that stored in the sediment storage area of each <br />pond.
