Therefore, the requirements in this paragraph are not ap- <br />plicable. <br />(11) All sedimentation ponds shall be examined by the operator for <br />structural weakness, erosion and other hazardous conditions. <br />(a) For sedimentation pond or impoundment with a capacity of <br />more than 1000 acre-feet, or with a dam or embankment in excess of <br />10 feet in vertical height, from the bottom of the channel to the <br />bottom of the spillway, or with a surface area at high waterline in <br />excess of 20 acres, examination shall be in accordance with the ap- <br />plicable requirements of the State Engineer. In such case, the <br />operator shall submit to the Division, proof of compliance with such <br />requirements. <br />(b) For a sedimentation pond or impoundment with an embankment <br />that is greater than 20 feet in height, as measured from the up- <br />stream toe of the embankment to the crest of the emergency spillway, <br />or having a storage volume of 20-acre-feet or more.
