Besponse: CYCC proposes to incorporate the Mine No, 3 and Middle <br />Creek Mine Detention basins into the plan for poet-mining land use <br />as stock watering ponds. Justification for approval of the deten- <br />tion basins ae permanent impoundments is provided in Addendum 1 to <br />revised Exhibit 3a, Sediment Control plan. <br />(10) Sedimentation control reservoirs. If a sedimentation pond has <br />a capacity of more than 1000 acre feet, or has a dam or embankment <br />in excess of 10 feet in vertical height, from the bottom of the <br />channel to the bottom of the spillway, or has a surface area at high <br />waterline in excess of 20 acres, then each plan shall meet the ap- <br />plicable requirements of the State Engineer in accordance with <br />C.R.S. 37-87-105. In those cases where a sedimentation pond has an <br />embankment that is greater than 20 feet in height, as measured from <br />the upstream toe of the embankment to the crest of the emergency <br />spillway, or has a storage volume of 20 acre-feet or more, then the <br />permittee shall meet the criteria of the Mine Safety and Health Ad- <br />ministration, 30 CFR 77.216 and the following additional criteria <br />shall be met: <br />(a) An appropriate combination of principal and emergency <br />spillways shall be provided for surface coal mining operations to <br />safely discharge the runoff resulting from a 100-year, 24-hour pre- <br />cipitation event, or a larger event specified by the Division, plus <br />in the case of underground mining activities, inflow from the under- <br />ground mine; <br />
