<br />STIPULATION N0, 7 <br />WITHIN 30 DAYS OF PERMIT ISSUANCE THE PERMITTE MUST SU$MIT DESIGNS FOR <br />THE MIDDLE CREEK DETENTION BASIN ADEQUATE TO CONTAIN THE FLOWS FROM THE <br />10 YEAR - 24 HOUR STORM AND IN CONFORMANCE WITH RULE 4.05.6. APPROVAL OF <br />THE DESIGN MUST BE OBTAINED PRIOR TO CONSTRUCTION, <br />Response: CYCC has revised the design of the Middle Creek Detention <br />Basin to provide additional detail in accordance with Rule 4.05.6, <br />including the capacity to contain the runoff from a 10-year, 24-hour <br />storm. The designs submitted supersede those in Rahibit 3 of the <br />permit, Sediment Control Plan. To facilitate review, the following <br />response adheres to the format of Rule 4.05.6 <br />Rule 4.05.6 Sedimentation Ponds <br />(1) General requirements. Sedimentation ponds shall be used indi- <br />vidually or in series and shall: <br />(a) Be constructed before any disturbance of the undisturbed <br />area to be drained into the pond and prior to any discharge of water <br />to surface waters from underground mine workings; <br />(b) Be located as near as possible to the disturbed area and <br />out of perennial streams, unless approved by the Division; and <br />(c) Meet all the criteria of 4.05.6. <br />Response: The Middle Creek Detention Basin is an excavated pond <br />which will be constructed [o achieve compliance with Rule 4.05.6. <br />The pond is located as near ae possible to the area of disturbance ~ <br />
