Mr. Jim Tatum -2- October 13, 1993 <br />property in relation to a water well on your property, this concern was apparently raised after <br />the approval of both the original state mining permit in 1984 and the permit expansion in 1990. <br />We would also appreciate a copy of the consummated lease that appears to have resulted <br />subsequent to your letter of April 2, 1991 to KN Energy, Inc., especially any language regarding <br />the existence and protection of your well. As we stated in our letter of August 20, 1993, the <br />current Basin Resources, Inc. permit for the Golden Eagle Mine does not reflect the existence of <br />this well, and may require modification to do so. Having this documentation will assist us in <br />determining Basin Resources' responsibilities pursuant to the Colorado Mined Land Reclamation <br />Board's Regulations for Coal Mining. <br />As a final note, we reiterate our January 19, 1993 request for information regarding this water <br />well. Specifically, our paragraph entitled "Response to Question No. 4" requested (1) a map <br />showing the well's location relative to the exhaust fan site; (2) the depth of the well; (3) the <br />historic water level of the well; (4) the range in the well's water level due to seasonal <br />fluctuation; (5) the date when the well last exhibited its historic water level; (6) the date the <br />well was first observed as being dry; and (7) the amount of water the well was previously <br />capable of producing. We have yet to receive this information. Having this information may <br />assist us in ascertaining the possible degree of impact, and any associated level of potential <br />compensation, by Basin Resources. <br />Should you have any further questions, please contact us. <br />Sincerely, <br />Daniel I.
