Long <br />Dnis~on Director <br />On September 20, 1993, we received your letter dated September 15, 1993, regarding the <br />Golden Eagle Mine. We wish to take this opportunity to provide our responses. <br />Regarding your comment that the Division, in its letter of August 30, 1993, stated that no <br />mining operations have occurred closer than 700 feet to your residence, we recommend you <br />review our letter. Nowhere in our August 30, 1993 letter did we state this. <br />We believe you are referring to our letter of July 7, 1993 in which we stated, "the mine has <br />not expanded closer than 750 feet of your home." However, if you review our <br />August 12, 1993 letter to Michael A. Ossola with the Las Animas County Planning and Land <br />Use Office (a copy of which was mailed to your office, you will observe that the Division <br />recalculated this figure, and stated that the extent of underground mine workings stopped <br />362.5 feet from your residence. <br />Regarding your comment about the angle-of-draw effect upon your residence from the under- <br />ground workings, please review both our letter to you of July 7, 1993 and our letter to <br />Mr. Ossola of August 12, 1993. In both of these letters, we state that, as room-and-pillar <br />operations at the Golden Eagle Mine were approved with a 50 percent eMraction mining limit <br />(that is, 50 percent of the coal remained in place) to provide anon-subsiding condition under <br />the Purgatoire River Valley, we do not believe that any subsidence is occurring in the Purgatoire <br />River floodplain. As such, we do not anticipate any angle-of-draw effect to occur in that area <br />as well. <br />Regarding your copy of your April 2, 1991 letter to Robin Forte of KN Energy, Inc., Lakewood, <br />Colorado, we would like to request a copy of any response provided by KN Energy, Inc. to this <br />letter, as well as copies of any documentation you may have describing the current relationship <br />between KN Energy, Inc. and Basin Resources, Inc. Please note that while it is apparent that <br />KN Energy, Inc. was made aware of your concerns with the existence of an airshaft on your <br />
