<br />e • • <br />~, r <br />XXVI. Operations on Lands Subject to Limitations or Prohibitions - <br />u es an <br />The proposed permit area is not within; <br />1. An area designated unsuitable for mining; <br />2. An area under study for designation as unsuitable for surface coal <br />mining; <br />3. Any lands subject to other prohibitions or limitations; or <br />4. One-hundred feet of the outside right-of-way of any public road. <br />5. Three hundred feet of an occupied dwelling not subject to valid <br />existing rights. <br />This operation is in compliance with the requirements of this section and <br />Rule 2.07.6(2)(d). <br />XXYII. Demonstration that Surface Coal Mining and Reclamation Operations can <br />Contingent upon the satisfactory resolution of stipulations presented in <br />the findings document, the following finding of compliance is valid. <br />The Division finds, pursuant to Rule 2.07.6(2)(b), based on information <br />in the application and from all available sources, that surface coal <br />mining and reclamation operations can be feasibly accomplished under the <br />Mining and Reclamation Plan contained in the application. The operation <br />is in compliance with the requirements of this section, <br />XXVIII.Compatibility with Anticipated Adjacent_Operations - Rule 2.07.6(2)(1) <br />Pursuant to Rule 2.07 ,6 (2)(i), the Division finds that WFC operations <br />will not be inconsistent with other operations anticipated to be <br />conducted in the areas adjacent to the permit area. <br />The operation is in compliance with the requirements of this section. <br />XXIX, Reclamation Fees Required by 30 CF R, Chapter VII, Subchapter R - <br />I~u 1 e I:I3T.6T' o - - - - <br />Information from the OSMRE supplied Automated Violater System (AVS) on <br />May 21, 1990 confirmed that reclamation fees are required by 30 CRF, <br />Chapter YII, Subchapter R., have been paid, Therefore, the Division <br />finds that the proposed operations is in compliance with <br />Rule 2.07,6(2)(0), <br />/ern <br />2010E <br />-33- <br />
