The dam was constructed in 1965 and has <br />served as a major flood control structure ever since that time. On <br />flood level measurements made by the Corps of Engineers and <br />previously submitted to the Division, the effect of the Paonia <br />Reservoir on flood stage levels near the Bear No. 3 operation were <br />not considered; tlierer'ore, with the proper use of regulating flow <br />from the Paonia P.eser-voir, the Corps of Engineers can assure that <br />the flovding downstream will be minimized or eliminated. <br />Furthermore, during the relocation of the river channel by the <br />Colorado Division of Highways during the reconstruction work for <br />State Highway 133, special attention will be given by the Colorado <br />Division of Highways to reconstructing the channel so that flood <br />potential is minimized or completely eliminated. <br />Stipulation No. 3 <br />As discussed on page 2:04-29 of the Eear Coal Ccm~pany permit <br />application, no water has ever been produced from the workings of <br />the old Edv;ards 11ine; and, therefore, no problems with water <br />discharging from the Bear Ne. 3 portals are expected.
