' ,. -,. <br />XIII. Vegetation - Rules 2.04.10 and 2.05.4(2)(e) <br />The Division has reviewed the information submitted by the applicant. The <br />applicant has supplied site specific baseline information as required by <br />Rule 2.04.10. in Section 2.04,10 of the permit application. The revegetation <br />plan is found in Section 2.05,4(2)(e). During the review process, the <br />Division had concerns with the adequacy of sample data collected during <br />baseline studies. The applicant responded by performing more extensive cover <br />and production sampling until adequate data was acquired. <br />As allowed by Rule 4.15.7(2)(d)(vi), the applicant requests that revegetation <br />success standards be established by the Division. Based on review of the <br />baseline data submitted by the applicant, the Division hereby establishes the <br />following standaras for successful revegetation: <br />Vegetative cover: 43% <br />Herbaceous production: 514 lbs/ac. {air dry weight) <br />Woody plant density: 65 stems/acre <br />Diversity: at least 3 warm season grasses, 2 cool season grasses and <br />1 perennial forb, each contributing at least 3%, but not more <br />than 40% of relaiive cover. <br />The approved seed mix consists entirely of native species, all of which occur <br />in the vicinity of the proposed operation. The species are compatible with <br />post-mining land use of pasture and rangeland. None are listed as poisonous <br />or noxious weeds. The applicant proposes to apply straw mulch following <br />seeding. <br />The proposed operation is in compliance with the requirements of this section. <br />XIV. Fish and Wildlife = Rules 2:05.6(2) and 4:18 <br />The fish and wildlife resource baseline information and fish and wildlife plan <br />of the application are found in Section 2.04.iT and 1.05.6(2). Based on the <br />information provided from the Colorado Division of Wildlife, it has been <br />determined that there are no major wildlife concerns for this operation. <br />Pursuant to Rule 2.07.6(2) and on the basis of available information, the <br />Division finds that the proposed operation will not affect the continued <br />existence of endangered or threatened species or result in the adverse <br />modification of their critical habitats. <br />The operation is in compliance with the requirements of this section. <br />XV. Prime farmland - Rules 2.04.12, 2.06.6 and 4.25 <br />The Division has made a negative determination for the presence of prime <br />farmlands within the proposed permit area. The decision was based on <br />information provided by the applicant on 2.04.12 of the permit application and <br />additional information provided by the Soil Conservation Service in Trinidad, <br />Colorado. <br />The Division, therefore, finds the operation is in compliance with <br />' Rule 2.07.2(k) with respect to prime farmlands. <br />- 16 - <br />
