<br />Mr. Steve Self - 2 - March 26, 1991 <br />set forth in public documents or plans, such as permits or approvals issued by <br />local, state or federal agencies, the permittee must modify the Mined Land <br />permit to eliminate discrepencies. Modifications of this nature would be <br />accanplished through the permit revision process. <br />Blowing Coat Oust and Potentia] Hydrologic Impacts <br />A review of the hydrologic baseline information contained in the Eastside <br />permit document and the upstream and downstream surface water monitoring <br />conducted by Eastside since 1985 supports your assertion that the Eastside <br />operations have not diminished the water quality in Harvey bap or the Farmer's <br />Ditch below the mine. Data from indicator parameters such as conductivity, <br />pH, total dissolved solids, sulfate and sodium, which could possibly be <br />elevated as a result of mine water discharge or leaching of drainage water <br />through coal fines, have been examined. The data does not indicate that <br />detectable trends exist. These evaluations were based on a same day <br />comparison of upstream and downstream sampling stations, and on a comparison <br />of baseline data with subsequent monitoring data. <br />Compliance with the aRDroved air pollution control plan and permit should be <br />sufficient to minimize the hydrologic impacts associated with blowing coal <br />dust and to prevent material damage to Farmer's Ditch water which is used for <br />both domestic and agricultural purposes. The Division will insure that this <br />is the case through regular site inspections, periodic hydrologic monitoring <br />and consultation with the Air Pollution Control Division (AP CD ), We have <br />requestd that APCD conduct a site inspection upon resumption of mining <br />operations. <br />The surface water description and hydrologic impact mitigation sections of the <br />permit application will need to be revised to acknowledge and describe the <br />domestic use of Farmer's Ditch water. These sections should also discuss the <br />potential impact of the operation on the domestic use. This information <br />should be included within a technical revision application to be submitted no <br />Later than May ], 1991. Since the letter which Eastside sent to Farmer's <br />Ditch shareholders did not specifically inquire as to whether the water was <br />used for drinking, tine impact evaluation in the technical revision application <br />should include the assumption that the water is usea for drinking. <br />To summarize, we are requesting the following .in.fnranation <br />Documentation cf county approval a~~d to::'ii ~~:atian of EasttsidF c:oa1 <br />Company's intent to mine at a limited pradriction level, or <br />submittal of a Notice of Temporary Cessation by April 15, 1991. <br />2. Submittal of a technical revision application addressing domestic <br />use of Farmer's Ditch water and potential impacts of the Eastside <br />Mine on that use by May 1, 1991, <br />
