Banta. <br />DimSion Dire,(pr <br />This letter is in response to information you submitted concerning questions <br />raised in our letter of February 4, 1991 regarding various aspects of the <br />Eastside Operation, <br />Compliance with County Permitting Requirements <br />Based on recent communication with the Garfield County Planning Department, it <br />is our understanding that the Garfield County Commissioners have determined <br />that Eas-'side Coal Company has the legal right to operate the Eastside Mine on <br />a limited basis (857 tons per year) as a pre-existing non-conforming use, <br />Please confirm whether Eastside intends to operate the mine at this level of <br />producti~m until a special use permit authorizing a higher level of production <br />is obtained. If Eastside does not intend to operate the mine at the limited <br />production level, we request th at you submit a No*_i~e of Temporary Cessation <br />pursuant to Rule 4.30.1 no later than April 15, 1991. <br />Removal of Rifle Loadout from the Permit Area and Associated Life of Mine <br />Issues <br />Your response letter of February 19, 1991 has adequately addressed the <br />questions raised regarding life of mine plans for transporting coal to <br />market.
