Technical Revisions since Renewal No. 4 (July 2004) <br />Revision Number Description Date Approved <br />TR-60 Refuse Reclamation Changes Oct 2004 <br />TR-61 Methane Degas Wells June 2005 <br />Section III <br />Status of Stipulations <br />The stipulation history for the Deserado Mine was reviewed as part of the mid-term <br />review. The following is a discussion of the stipulations that were noted as active or <br />future in the database, or issued as a result of the last permit renewal (RN-04). Review <br />included investigation of the stipulation response file, revisions to the permit, and the <br />findings document for RN-04. Stipulations are a binding part of the permit and <br />previously assigned stipulation numbers are not to be re-used. Any stipulations <br />associated with this permit and issued over the life of this operation which are not <br />discussed in this mid-term review have been complied with or terminated. <br />There are three active stipulations for this mine site. All of the stipulations are perpetual <br />in nature and impose possible future obligations on the permittee when conducting <br />operations on BLM lands. <br />Stipulation No. 50 <br />Protection of Archaeological Resources <br />IF OPERATOR DISCOVERS ANY CULTURAL REMAINS, MONUMENTS OR SITES, <br />OR ANY OBJECT OF ANTIQUITY, OPERATOR SHALL IMMEDIATELY CEASE <br />ACTIVITY AND REPORT DIRECTLY TO BLM AREA MANAGER. THE BLM SHALL <br />TAKE ACTION AS REQUIRED UNDER THE ACTS AND REGULATIONS. <br />OPERATOR SHALL FOLLOW MITIGATION REQUIREMENTS SET FORTH BY BLM <br />CONCERNING PROTECTION, PRESERVATION OR DISPOSITION OF ANY SITES <br />OR MATERIAL DISCOVERED. COST OF SALVAGE EXCAVATION, IF NECESSARY, <br />SHALL BE BORNE BY THE OPERATOR UNLESS OTHERWISE STATED. <br />7 <br />
