Lung
Division Director
During our meeting of May 11, 1994, I hand-delivered my letter of
May 10, 1994. This letter documents the OWNERS position regarding
the CONTRACTORS concerns and also the OWNERS concerns. As I
informed you, the letter was subject to some modification and
clarification as a result of new information obtained by actual
field measurement of the topsoil stockpiles and CONTRACTOR
disturbances.
Field observations and measurements using a measuring wheel were
made by John Nelson (PROJECT MANAGER) and me on May 11, 1994.
Based upon these measurements, the May 10, 1994 letter is modified
as follows;
1. The previously stockpiled topsoil located on the north end of
Chen's Hill actually contains 4,700 cubic yards, not 2,800 cubic
yards.
2. The previously stockpiled topsoil located in the East Pit area
actually contains 5,900 cubic yards, not 5,000 cubic yards.
3. The CONTRACTOR disturbed an additional 175'X45' portion of the
revegetated area located adjacent to the Chen's Hill spoil disposal
site. The topsoil is still in place and one 6' Ponderosa Pine tree
was destroyed. The CONTRACTOR is responsible for the revegetation
of this site at no cost to the OWNER. Revegetation shall include
all of the same requirements listed for the GEC/East Pit Coal
Reclamation Project (RN-MINES-322). The 6' Ponderosa Pine tree
must be replaced in kind at no cost to the OWNER.
4. The disturbance of previously-reclaimed land adjacent to Chen's
Hill is 2.54 acres, not 2 acres. This area is being used to
dispose of Chen's Hill cut material. The amount of topsoil lost
below this disposal site is 2,050 cubic yards, not 1613 cubic
yards.
