Lung <br />Division Director <br />During our meeting of May 11, 1994, I hand-delivered my letter of <br />May 10, 1994. This letter documents the OWNERS position regarding <br />the CONTRACTORS concerns and also the OWNERS concerns. As I <br />informed you, the letter was subject to some modification and <br />clarification as a result of new information obtained by actual <br />field measurement of the topsoil stockpiles and CONTRACTOR <br />disturbances. <br />Field observations and measurements using a measuring wheel were <br />made by John Nelson (PROJECT MANAGER) and me on May 11, 1994. <br />Based upon these measurements, the May 10, 1994 letter is modified <br />as follows; <br />1. The previously stockpiled topsoil located on the north end of <br />Chen's Hill actually contains 4,700 cubic yards, not 2,800 cubic <br />yards. <br />2. The previously stockpiled topsoil located in the East Pit area <br />actually contains 5,900 cubic yards, not 5,000 cubic yards. <br />3. The CONTRACTOR disturbed an additional 175'X45' portion of the <br />revegetated area located adjacent to the Chen's Hill spoil disposal <br />site. The topsoil is still in place and one 6' Ponderosa Pine tree <br />was destroyed. The CONTRACTOR is responsible for the revegetation <br />of this site at no cost to the OWNER. Revegetation shall include <br />all of the same requirements listed for the GEC/East Pit Coal <br />Reclamation Project (RN-MINES-322). The 6' Ponderosa Pine tree <br />must be replaced in kind at no cost to the OWNER. <br />4. The disturbance of previously-reclaimed land adjacent to Chen's <br />Hill is 2.54 acres, not 2 acres. This area is being used to <br />dispose of Chen's Hill cut material. The amount of topsoil lost <br />below this disposal site is 2,050 cubic yards, not 1613 cubic <br />yards. <br />
