Drainage will be restored to <br />approximate pre-mining conditions. <br />Salt Creek tLining Company has proposed to partially backfill cut slopes at <br />the mine portal bench. Natural slopes in the vicinity are very steep and <br />complete backfilling of the existing cut slopes •:ould be difficult. The <br />applicant has not provided enough analysis to suggest that the slopes will <br />be stable is a partially backfilled situation. The following stipulation <br />will have to be satisfied before the Division can ma'~e a finding of <br />compliance with this section. _ . _ _ <br />14. WITHIN SIX MONTHS OF PER"fIT ISSUANCE THE PER`fITTEE MUST PROVIDE THE <br />pIVISION WITH A SPECIFIC PROPOSAL FOR THE FINAL CONFIGURATION OF THE <br />PORTAL BENCH CUT. SUFFICIENT ANALYSES MUST ALSO BE PRESENTED TO VERIFY <br />THAT THE PROPOSED FINAL CONFIGURATION WILL MEET ALL STABILITY REQUIR&`fE`+TS <br />OF RULE 4.14. IF THE FINAL CONFIGURATION idILL VARY FROM THE APPROXIMATE <br />ORIGINAL CONTOUR OF THE AREA, THE PER`fITTEE MUST REQUEST A VARIANCE IN <br />ACCORDANCE WITH RULE 2.06.5. . <br />b). 2.05.4(27(a). 2.05.4 <br />If underground development waste is generated during mining (through roof <br />fall, etc.) it will be retained in the aline workings. The current plan <br />does not alloy the placement of aay such waste into a waste pile at the <br />McClane Canyon site. <br />Ptine <br />S <br />ort <br />The mine facilities portion of the application can be found in Section 2.2 <br />of the application, The McClane Canyon operation will use the loadout <br />facilities near the town of Loma, Colorado. The Loma loadout will be <br />permitted under the Munger Canyon application. <br />The operation is in compliance with this section of the Rules and Regulations. <br />XVIII. Roads - Rules 2.05.3(3) and 4,03 <br />Section 2.2.2 of Volume I of the permit application contains the required <br />information with respect to access and haul roads at the McClane Canyon site. <br />Figure 2.2-5 of the application indicates a section of the road which had to <br />be cut into the canyon wall where the cut slopes are approximately 1v:0.13h <br />(cross-section C-C). This slope exceeds the required 1v:1.25h which is given <br />in the rules are regulations. <br />Should failure occur at this cut, the material would fall onto the road and <br />would possibly block the road drainage. These cut slopes are similar to <br />the natural slopes existing above the cuts in the canyon walls. Because <br />slides from these cut areas do not present a po[ential for serious <br />environmental harm and have not demonstrated instability in the past, and <br />because the apolicant is required to maintain ditches and roads these <br />excessive slopes are per:nissable and mee[ the rAauirements of Rule 4.03.'_ <br /> <br />
