_,D_ <br />-~ II. Land Use - Rules 2.04.3, 2.05.5, and 4.16 <br />Pages 4-1 and 4-5 of Volume 1 of the application contain the infornation <br />pertinent to rules concerning land us=_. The following determinations have <br />been made for the operation. <br />In the area surrounding the operation the predominent land use designations <br />are rangeland and wildlife habitat. The canyon which the operation occupies <br />is characterized by steep slopes and fairly sparse vegetation. Rangeland is <br />restricted to the valley bottoms which hare shallow slopes and sufficient <br />vegetation. The applicant proposes to return the operation to rangeland and <br />wildlife habitat by restoring preminiag vegetation patterns of distribution. <br />Pursuant to Rule 2.07.6(2)(1) the Division finds that the proposed postmining <br />land use of the pernit area meets the requirements of Rule 4.16. <br />The operation'_is in compliance with the requirements of this section. <br />III. Cultural and Historic Resources - Rules 2:04:4 and~2:05.b(4) <br />Information appropriate to Cultural ac3 Historic Resources can be found in <br />Section~4.1.3 of Volume I and in Appendi= J of Volume IV of the application. <br />A number. of cultural resource studies have been prepared for Sheridan Enter- <br />prises' IfcClane and !longer Canyon coal nine areas in Garfield County, Colo- <br />rado. Chief among the reports is a submission by the Grand River Institute, <br />1980 and two survey reports by the :luseum of Western Colorado of work con- <br />ducted is the area is 1977. She surveys covered roads, drill hole locations, <br />areas of potential sutfa.ce disturbance and a sample survey of areas that in <br />the future may be affected by subsidence. A total of three archeological <br />sites (two pre-historic and one historic) and one suspect area were recorded <br />during the survey. Two of the sites, SC 743, 742 are located oa or near the <br />McGlone Canyon property. Questions concerning the surveys reports and sites <br />have been satisfactorily resolved by discussions and correspondence between <br />OS:1 sad Sheridan Enterprises and the State of Colorado. <br />Archeological site SGF742 identified near the mouth of lScClane Canyon is a <br />rock shelter and is considered eligible for listing on the National Register <br />of Historic Places. The site is not located in an area which will be dis- <br />turbed by the operation. Since the site is not going to be disturbed, a miti- <br />gation plan is not required: <br />Adequate data has been submitted by the applicant and OS!! has received concur- <br />rence frog the State Historic Preservation Officer that site SGF742 is eligi- <br />ble for listing in the National Register and in a "No Effect Detem ination" <br />I'he Division and the Office of Surface Mining (OS:1) require that the following <br />stipulation be attached to this documenC in the event Chat any further cultur- <br />al resources are encountered during the operation. <br />~3 <br />~~ <br />
