<br />also due to the fact that no mixing of Surface drainage with <br />a discharge from underground workings will occur. The small <br />areas to be exempted are specified on Drawing 5-019, Map <br />EB-3255, and Appendix B (4.05.2(3)(b>(i)). <br />8. Diversions and Conveyance of Overland Flow <br />Specific drainage control plans are presented in Appendix B. <br />Ditch locations are shown on Map E3-3255, and Drawing 5-019. <br />C. Stream Channel Diversions <br />The Division has approved the diversion of an intermittent <br />stream (Elk Creek). This decision is based on a finding that <br />the proposed diversion meets the requirements of 4.05.18 and <br />4.05.4, applicable local, State, and Federal statutes and <br />regulations and that the diversion is designed to safeguard <br />public safety and to minimize adverse impacts to the <br />hydrologic balance (4.05.4(1) and (4)). <br />D. Sedimentation Ponds <br />Disturbed areas in the Elk Creek yard are treated by 13 <br />sediment ponds. The Division approved a revision (Technical <br />Revision OS) to restructure the sediment control system. <br />These activities involve removal of 11 ponds and enlargement <br />of Pond No. 11 and Pond No. 12. The Nubbard Creek Pond and <br />East Yard Pcnd both remain intact. Cne additional pond is <br />approved for treatment of underground discharge from the <br />Sanborn Creek Mine. Specific plans are found within Appendix <br />B of the permit document. A.11 ponds are designed in <br />compliance with Rule 4.05.6. <br />E. Acid-forming and Toxic-forming Spoil <br />There is no evidence cf acid- or toxic-forming material at <br />this site. <br />F. Impoundments <br />Refer to Section D, Sedimentation Pond;, above. <br />G. Surface and Ground Water Monitoring <br />The applicant will conduct monitoring of ground seater in a <br />manner approved by the Division. The ground seater monitoring <br />plan is specified on ?age 2.04-46i of the permit document <br />(4.05.13(1)>. <br />2. The applicant will conduct monitoring of surface seater in a <br />manner approved by the Divi;icn.
