FAILURE TO COMPLY WITH THIS OR ANY OTHER CONSTRUCTION REQUIREMENT <br />MAY RESULT IN THE IMMEDIATE SUSPENSION OF WORK BY ORDER OF THE DEPARTMENT OF <br />TRANSPORTATION. <br />24. No drainage from this site shall enter onto the Staze Highway 550 uavel lanes. The access shall be constructed and <br />maintained in a manner that will not cause water to enter onto the roadway, and will not interfere with the existing <br />drainage within the State Highway 550 right-of-way. Drainage to the State Highway right-of-way shall not exceed the <br />historical rate of flow. <br />25. Incorporated as part of this permit are the following: Application for Access Permit dated July 3, 2003 (Form No. 137) <br />and attachments, Permit Pages lOla and lOlb, Permit Terms and Conditions Pages 2 through 4, EXHIBIT A, Colorado <br />Department of Transportation M and S Standazds M-203-1 and 607-1. <br />26. The Permittee(s)/Property owner(s) are hereby notified that the location, configuration, or design of this access [tray be <br />altered by CDOT during future highway construction. Left turn movements in and out of this access may be prohibited <br />at some future date. <br />27. If necessary, minor changes, corrections and/or additions to this permit shall be ordered by the Maintenance Foreman <br />or other CDOT representative to meet unanticipated site conditions. <br />28. In the event it becomes necessary to remove any right-of--way fence, the posts on either side of the access shall be <br />securely braced with approved end posts and bracing in conformance with M-607-1, before the fence is cut to prevent <br />slacking of the remaining fence. All posts and wire removed shall be returned to the maintenance shop, a[ the direction <br />of the local Maintenance Foremast. <br />29. The applicant is hereby notified that a fencing agreement with the Depaztment is required for any decorative fence that <br />is erected within the highway right-of-way. Please contact Mr. Darrel Lowder, Region 5 Senior Right-Of-Way Agent a[ <br />3803 North Main Avenue, Suite 300, Durango, Colorado 81301, or call (970) 385-1400 within sixty (60) days of this <br />peanit transmittal date. <br />30. All existing right-of-way mazkers shall be protected during construction of this access. Any damage to these markers <br />shall require resetting by a Colorado Professional Land Surveyor. <br />31. The Permi[tee must notify owners or operators of underground utility facilities at least two (2) business days prior to <br />making or beginning excavations in the vicinity of such facilities, as required under Section 9-1.5-103, Colorado <br />Revised Statutes. Cull Utility Notification Center of Colorado (UNCC), 1-800-922-1987 for mazking of member <br />utilities. Call Non-member utilities directly. <br />32. The Permittee shall be responsible for verification of existing utility locations. If any damage occurs to these utilities <br />during construction, it shall be the Perrnittee's responsibility to repair or replace the utility at no cost to the department <br />33. The Pemtittee shall record a true and correct copy of this permit at the Ouray County Court House upon issuance by [he <br />Depariment of Transportation. Written certification of the recordation shall be provided to the Depaztment within thirty <br />(30) days of the permit issue date. <br />34. You must contact either Melinda D.
