Oct 17 03 08:43a Brian K. Briggs 970-325-0624 p.3 <br />ACCESS PERMIT TERMS & CONDITIONS <br />1. This pemtit is issued to permit and allow the relocation and a change in use of an existing access to Stale Highway 550 <br />located at approximate milepost 94.534 right. The existing access approximately 500' north and all other dime[ access <br />except the permitted location at milepost 94.534 fight shall be closed and removed. Al] access fill material shall be <br />removed and the azea(s) shall be bladed to match the surrounding ground contours. This permit hereby replaces permit <br />number 594049 and all previous access permit(s) for this ownership, which now becomes null and void. <br />2. The access shall serve that indicated on Page one (1); a 3.64 acre mining and crushing operation on a portion of the <br />Daisy Placer, U.S. Mineral Survey 2236, as shown on Plat of Survey of U.S. Forest Service S.T.A, 409 and 413 <br />recorded 02-07-1994 at Reception No. 155660, County of Ouray, Colorado. <br />3. Anew access application shall be submitted and a new access permit shall be issued by CDOT prior to use of the <br />property by the proposed single family homes or any increase in the herein permitted vehicular volumes, changes in the <br />type of business permitted, or any auxiliary lane construction activities. Under no circumstances will the access be <br />allowed to operate in an unsafe manner. <br />4. The access is permitted for a maximum of forty (40) feet wide at the Right-of--Way line with twenty-five (25) foot radii, <br />in conformance with the details shown on the Forsgren Associates Drawings 1-4 Dated 06-26-03 and 06-24-03 and <br />identified as EXHIBIT A and M&S Standazd 203-1, copy enclosed. <br />5. The access shall be perpendicular to the travel lanes of Stale Highway 550 for a minimum distance of 40 feet or to the <br />right-of-way, whichever is furthermost, and shall slope down and away from the adjacent pavement edge at a rate of 2% <br />for a minimum of 20 feet. <br />6. The access gate shall be set back so that the longest vehicle using [he access can completely cleaz the traveled way <br />when the gate is closed. <br />7. The access approach shalt be surfaced to the Right-of-Way Line with four (4) inches of Hot Bituminous Pavement <br />(HBP Grading S or SX), four (4) inches of Base Course (ABC Class 6) and ABC Class 1 Sub-Base (Depth to be <br />determined by the Senior Highway Foreman. Required depths indicate compacted material. Concrete pavement may be <br />used in lieu of bituminous pavement Concrete pavement shall meet the requirements of section 412 of the standard <br />specifications. <br />8. The need for a side drain cuivert will be determined at the time of construction by the local Maintenance Foreman. If <br />required, a new 18-inch corrtrgated steel or 21 inch x 15 inch azched steel pipe shall be used, as duec[ed. The <br />Maintenance Foreman may also require an increase in the size of the side drain [o adequately handle the historical <br />drainage flows. <br />9. The side drain culvert shall be of sufficient length to extend a minimum of two feet beyond the toe of the access slope. <br />The side drain shall be installed in a manner that provides proper drainage, with no less than twelve (12) inches of <br />compacted backfill material over the top of the culvert. In accomplishing this requirement it may be necessazy for the <br />permittee to perform some minor drainage ditch shaping. The side drain shall NOT be installed prior to review and <br />authorization from the Maintenance Foreman. <br />10. All required access improvements shall be installed within 45 davs of issuance of this permit, or as otherwise <br />authorized in writing by the Department. <br />11. This access shall be restricted to use by tracks no larger than single-unit 10 to 12 cubic yard "tandems'. <br />12. The vehiculaz volumes using this access shall not exceed an average Peak Hour Volume of twenty-five (25) right- <br />turning movements from State Highway 550 into the access. <br />13. The vehicular volumes using this access shall no[ exceed an average Peak Hour Volume of ten (10) left-turniltg <br />entrance movements from State Highway 550 into the access. <br />14. The vehicular volumes referenced above aze based on automobile operations. To allow for the impact of lazger trucks, <br />"passenger car equivalents" shall be determined. A passenger caz equivalent of 3 for all trucks and combinations of 40 <br />
