Harvard Ave., Ste. 400 <br />Denver, Colorado 80231 <br />RE: Draft Stipulation No. 12 (Stipulation No. 9) <br />Seneca II-W Mine - File No. C-82-057 <br />Dear Mr. Pfannenstiel: <br />The Division has received Peabody Coal Company's response to Stipulation No. 9 <br />(Draft-Stipulation No. 12) in the "Proposed Decision and Findings of <br />Compliance for the Seneca II-W Mine". <br />Division personnel have reviewed the response and deemed it deficient for the <br />following reasons. <br />To resolve this stipulation, Peabody needs to demonstrate that the owner <br />of the well has been contacted, and that he/she has defined what limits of <br />vibration the casing will withstand. <br />Furthermore, the Division believes that it would be appropriate to <br />determine what level of vented gas actually exists prior to blasting. <br />This may be measured with an appropriate hydrocarbon sniffer. <br />If you have any questions, please contact me. <br />Sincerely, ~~ <br />~• / <br />Steven Renner <br />Hydrologist <br />SR/mis <br />4374E <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
