We believe that this request fits that
definition as we are not asking for any changes to the reclamation
plan other than reduction of acreage (which was imposed upon ROBCO
by the State Highway Department) and timing of mining in Stage One
due to changes in market conditions. In fact, by not requesting a
reduction in the financial warranty, the financial warranty now
covers fewer acres meaning a higher dollar per acre warranty than
the CMLRD previously held.
Attached are two exhibits. Exhibit A shows the CDOH taking for
C470. Exhibit H is the revised Mine Plan map which shows the total
area in grey of 35.45 acres which we are requesting to be removed
from Stage One as well as the revised area of Stage One which is
27.68 acres in size. We have not shown Stage Two or Three as they
remain the same as in the original permit. The new west boundary
line of Stage One is the east boundary of the property taken for
C470. The north, east, and south boundaries remain the same as in
the original permit,
Please let me know if this information is sufficient or if anything
else will be needed to successfully complete this TR request. I am
leaving town on June 11th and will be back in the office on June
23rd in case you or your staff need to contact me.
Sin 1 ,
~/~
C"`! paul G.
