In the process of the taking, another <br />portion of the permitted property was isolated from the existing <br />mine area. The isolated area lies to the west of C470 and the <br />existing mine area lies to the east of C470. There is no access <br />from the east property to the west. <br />We have already processed through the MLRD a request for release of <br />financial warranty for the effected lands. The property was <br />inspected on May 14, 1992 by Bill York-Feirn of your staff and the <br />property was released from the financial warranty. We did not <br />request a reduction in the financial warranty amount and asked <br />simply for a release of the property. I was notified by Bill that <br />the release has been approved. We ere now asking to complete the <br />second step of the process to bring the permit into conformance. <br />The only portion of the permit affected by this request is "Stage <br />One" which originally contained 63.13 acres with a planned mined <br />acreage of 32.55 acres. The amount of the property taken and <br />isolated together equals 35.45 acres. This means that Stage One is <br />now reduced to 27.68 acres in total size with a planned mined area <br />of approximately 24.9 acres. Most of the currently disturbed area <br />in Stage One was pre-law. <br />In addition to the changed acreage, Robinson Brick Company wishes <br />to revise the timetable contained in the original permit <br />application booklet on page 11. The time for Stage One is <br />requested to be changed from 10 - 20 years to 35 years (from <br />
