_ZZ_ <br />Stipulation No. 3 <br />PRIOR TO THE USE OF MINE WATER FOR ANY MINING ACTIVITIES OR DEWATERING <br />OF MINE WATER, TWIN PINES COAL COf4PANY, INC., MUST OBTAIN ALL STORAGE <br />AND WELL PERfAITS REQUIRED BY APPLICABLE STATE LAW. <br />B. Surface Water <br />Two ephemeral drainages, Lewis Gulch and South Oak Creek, drain the proposed <br />permit area and flow into Oak Creek north of the proposed permit area (see <br />Figure 2). <br />Two areas of concern for impacts to the surface water were identified during <br />review of the permit application: 1) general increases in suspended sediment <br />during mining and reclamation activities; and 2) possible long-term effects <br />to the stream channel if the Lewis Gulch Fill were to remain as a permanent <br />structure. These concerns were resolved during the permitting process as <br />follows: 1) The surface water control system was designed to reduce any <br />additional sediment load; and 2) The applicant amended the reclamation plan to <br />include removal of the Lewis Gulch fill (See sections XVII and XVIII of this <br />document}. <br />C. Finding <br />Upon acceptance of the above stipulations, the Division finds the proposed <br />operation is designed to minimize impacts to the prevailing hydrologic balance <br />in compliance with the requirements of this section. <br />CUMULATIVE HYDROLOGIC IMPACT STUDY <br />Rule 2.07.b(2)(c) requires the Division to make an assessment of the probable <br />cumulative impacts of all anticipated coal mining in the general area on the <br />hydrologic balance and to make a finding that the operation proposed in the <br />permit application has been designed to prevent material damage to the <br />hydrologic balance outside the proposed permit area. This Cumulative <br />Hydrologic Impact Study (CHIS) assesses the projected cumulative hydrologic <br />impacts of all anticipated coal mining operations in the general area of the <br />Twin Pines No. 2 Mine. Anticipated mining is defined as the proposed <br />life-oflnine areas for the existing permitted mines and those for which <br />complete permit applications have been submitted to the Division. <br />
