-11- <br />II. Land Use - Rules 2.04,3, 2.05.5 and 4.16 <br />Information pertaining to land use in the area can be found in Volume 1, pages <br />10-15 of the permit application. Both the pre-mining and post-mining land <br />uses are defined as wild]ife habitat and grazing. Since the post-mining land <br />use and the pre-mining land use are the same, the requirements of the <br />Regulations have been met. Therefore, pursuant to Rule 2.07.6(2)(1), the <br />Division approves the proposed post-mining land use of wildlife habitat and <br />grazing for the Twin Pines No. 2 Mine. <br />Approximately nine acres of the portal area were disturbed prior to the <br />enactment of the Colorado Surface Coal Mining Reclamation Act and have not <br />been reclaimed in accordance with the standards of this Act. Reclamation <br />success standards can be adjusted according to Rule 4.15.10 for previously <br />disturbed areas such as the portal area. Stipulations have been attached to <br />the vegetation plan (Section XI of this document) to develop reclamation <br />success standards for areas to be reclaimed. Based on the satisfactory <br />resolution of those stipulations, the Division finds that achievement of the <br />proposed post~nining land use on previously mined areas will restore those <br />areas to conditions that are capable of supporting a higher use. <br />The existing Fremont County road to the portal will be upgraded as part of the <br />Twin Pines mining operation. The County has requested that the road be left <br />as part of the post-mining land use. The Division, in accordance with Rule <br />4.03.2(7)(a), approves of the retention of the read. <br />The Division finds the proposed operation in compliance with the requirements <br />of this section. <br />III. Cultural and Historic Resources - Rules 2.04.4 and 2.05.6(4) <br />Information pertaining to cultural and historic resources information is <br />provided in Volume I, pages 16-18 of the permit application, On page 18 of <br />the application, the Colorado Historical Society's letter dated November 12, <br />1982 stated that there were no documented cultural properties in the area of <br />impact of the proposed mine . <br />Therefore, pursuant to Rule 2.07.6(2)(e), the Division finds that the mininy <br />operation will not adversely affect any publicly owhed park or place listed on <br />the National Register of Historic Places. <br />IV. Geology - Rules 2.04.5 and 2.04.6 <br />Geologic information is presented in Volume 1, pages 19-12 and pages JFSA 7-21 <br />of the Twin Pines No. 2 Mine permit application. The Small Operators <br />Assistance Program (SOAP) was used to determine the probable hydrologic <br />consequences of mining. Detailed regional and site-specific geology was <br />prepared which included structure, stratigraphy and overburden assessment. A <br />summary of this geological information is presented as part of the probable <br />hydrologic consequences section of this document, Section VIII. The relative <br />stratigraphic location of the seam to be mined, the Brookside seam, is shown <br />on the attached Generalized stratigraphic Column, Figure 4. <br />
