• L.T1~1Di+ r~F;LFr 1...=:FL..ATra i.IJ~CfI F'ES <br />RESOLUTION NO. 1993-55 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br />LA PLATA COUNTY, COLORADO, ADOPTING, AMENDING AND <br />RENUMBERING THE ANIMAS VALLEY LAND USE PLAN AND MAP, <br />ADOPTING REGULATIONS FOR THE ADMINISTRATION OF <br />NEIGHBORHOOD ZONING DISTRICTS AND MAKING <br />CORRESPONDING AND IMPLEMENTING AMENDMENTS TO THE <br />LA PLATA COUNTY PERMIT SYSTEM. <br />~~. <br />WHEREAS, the La Plata County Land Use Plan and Implementing Regulations <br />entitled the "La Plata County Permit System and Appendices" were duly adopted by and <br />through Resolution No's 1990-39 and 1990-40; and <br />WHEREAS, the La Plata County Permit System was amended by and through <br />Resolution No. 1992-28; and <br />WHEREAS, public hearings before the La Plata County Planning Commission were <br />duly noticed and held on the 20th and 27th days of September, 1993, concerning the adoption <br />and certification of the Animas Valley Land Use Plan and Map, amendments to the Official <br />Development District Map, the Animas Valley Neighborhood Zoning Districts Overlay Map, <br />the adoption of certain Neighborhood Zoning District Regulations, and amendments to the <br />La Plata County Permit System and Appendices; and <br />WHEREAS, the above referenced plans, maps and amendments were certified to the <br />Board of County Commissioners by and through La Plata County Planning Commission <br />Resolution No. 1993-I on the 27th day of September, 1993, which Resolution is hereby <br />incorporated herein by this reference as if set forth in full; and <br />WHEREAS, the Board of County Commissioners of La Plata County, Colorado held <br />a duly noticed public hearing on the above referenced plans, maps, districts, regulations and <br />amendments on the 2nd day of October, 1993 and November 8, 1993; and <br />WHEREAS, pursuant to §§30-28-111, 112, 113 and 115, C.R.S., as amended, the <br />La Plata County Permit System and Appendices may provide, among other things, for <br />regulating the location, height, bulk, and size of buildings and other structures, the percentage <br />of lot which may be occupied, the size of yards, courts, and other open spaces, the uses of <br />buildings and other structures for trade, industry, residence, recreation, public activities or <br />other purposes, access to sunlight for solar energy devices, and the uses of land for trade, <br />industry, residence, recreation or other purposes, and for flood control; and in order to <br />accomplish this plan and implementing regulations may provide for the division of territory <br />within the unincorporated area of the County into districts of such number, shape, or area as <br />the Board of Commissioners may determine, and within such districts may regulate the use <br />of buildings, structures, and the uses of land, and may require and provide for the issuance <br />of building permits as a condition precedent to the right to erect, construct, reconstruct, or <br />alter any building or structure which is subject to such land use plan and regulations; and <br />
