• I have determined that approval of this mining plan modification will not have a <br />significant impact on the quality of the human environment. The environmental analysis <br />prepared by BLM and OSM and entitled "National Kirrg Coal, LLC Proposed Coal Lease <br />Modifcotion Applicnlion COC 6094/", November 1999, and other environmental <br />documents noted in the Finding of No Significant Impact (FONSI), describe the impacts <br />that may result from approval of [his mining plan modification and its altematives. The <br />FONSI and supporting environmental analysis are included in this decision document. <br />OSM's review of the proposed action did not identify any issues that required resolution <br />via the addition of special conditions to the mining plan approval. <br />Publication of four consecutive weekly notices in the Durango Herald newspaper notified <br />the public of the availability of the administratively complete PAP for review. The last <br />publicatiori date was February 2, 2000. No public comments on the PAP were received <br />after the public notice was published. <br />The DMG determined [hat a bond for $120,000 is adequate for the. Colorado Permit No. <br />CO-81-035 associated with this mining plan modification. The bond is payable to the <br />State and the United States. <br />A chronology of events related to the processing of the PAP and this mining plan decision <br />. is included with the decision document. The information in the PAP, and other <br />information identified in the decision document, has been reviewed by CO-DMG staff in <br />coordination with [he OSM Federal Lands Coordinator. <br />OSM's administrative record of this mining plan modification consists of the following: <br />-the PAP submitted by NKC and updated through November 13, 2000, <br />-CO-DMG's Proposed Decision and Findings of Compliance for Permit Revision <br />No. 7 provided to OSM under the cooperative agreement. <br />-the Environmental Assessment entitled "National King Coal, LLC Proposed <br />Coal Lease Modification Application COC 6094/", November 1999 <br />the FONSI of the proposed action and alternatives prepared by OSM, <br />-other' documents prepared by DMG, and <br />-correspondence developed during the review of the PAP. <br />Attachments <br />• <br />
