• Total Federal recoverable coal reserves for the Menefee Coal Bed No. 1 seam within the <br />current mining plan approval area would increase by 0.84 million tons for a new total of <br />5.6 million tons. <br />No Federal surface lands will be included in the mining plan area as a result of this <br />action. <br />The postmining land use within the permit and mining plan area will not change. <br />The CO-DMG has not attached any new permit stipulations [o this permitting action and <br />has not carried-over any other previous permit stipulations. <br />National King Coal, LLC's proposal does not require any special conditions to comply <br />with Federal laws. <br />V. Review Process <br />The CO-DMG reviewed the PAP under the Colorado Stale program, the Federal lands <br />program (30 CFR Chapter VII, Subchapter D), and the Colorado cooperative agreement <br />(30 CFR §30 CFR 906.30). Pursuant to the Colorado State program and the cooperative <br />agreement, CO-DMG approved the permit revision on January 19, 2001. <br />• The Office of Surface Mining Reclamation and Enforcement (OSM) has consulted with <br />other Federal agencies for compliance with the requirements of applicable Federal laws. <br />Their comments and/or concurrences are included in the decision document. <br />The Bureau of Land Management (BLM) reviewed [he resource recovery and <br />protection plan for compliance with the Mineral Leasing Act of 1920, as <br />amended, and 43 CFR Part 3480. T'he BLM recommended approval of the mining <br />plan modification in a memorandum dated Febntary 5, 2001. <br />In accordance with the September 24, 1996, Biological Opinion and Conference <br />Report from the U.S. Fish and Wildlife Service (USFWS) to OSM, OSM sought <br />comments from the USFWS on threatened and endangered species. The USFWS <br />concurred +vith OSM's determination that species-specific protective measures <br />will not need to be developed for this mining plan modification. <br />OSM concurs with [he State Historic Preservation Officer's (SHPO) assessment <br />and recommendations for protection of cultural resources, as stated in the SHPO <br />concurrence letter dated December 28. 1999. <br />The proposed area of mining plan approval is not unsuitable for mining according to <br />section 522(b) of SMCRA. <br />• The mining plan modification area is no[ on any Federal lands within the boundaries of <br />any national forest. <br />
