affected by subsidence. A total of three archeological sites (two <br />pre-historic and one historic) and one suspect area were recorded during <br />the survey. <br />Several concerns were raised by the Division and the Office of Surface <br />Mining (OSM) during the review of the cultural resources survey. The <br />applicant was asked to define the extent of the survey, explain sample <br />selecting procedures and supply a review of the areas historic <br />development. The applicant satisfactorily addressed these three items. <br />Two sites identified during the cultural resources survey are located <br />within the Munger Canyon Mine plan boundaries. Site 5GF742, a pictograph, <br />is recommended as being eligible for listing on the National Register of <br />Historic Places, while 5FG743, an old homestead, is not. The homestead is <br />adjacent to the haul road for the mine, with the pictograph further <br />removed from the road on the canyon wall. Neither site will be disturbed <br />by the proposed operation. Because of this, and since 5GF742 is not <br />actually listed on the National Register of Historic Places, a mitigation <br />plan is not required (see Rule 2.05/6(4)). <br />An additional cultural resource study was prepared for Salt Creek Mining <br />Company in 1983 by the Grand River Institute, entitled "Cultural Resources <br />Inventory of Several Proposed Roads and Storage Areas Associated with the <br />McClave and Munger Canyons Plan/Permit Areas in Garfield County, <br />Colorado" (GRI Project No. 8292). This study can be found in Appendix Is <br />of Volume VI of the application. The survey covered areas associated with <br />the proposed central facilities area permit revision. <br />Three prehistoric (5GF1147, 5GF741, and 5GF742) and three historic <br />(5GF742, 5GF326, and 5GF879) sites were identified. Five sites fall <br />within the project boundaries (5GF1147, 5GF742, 5GF743, 5GF326, and <br />5GF879) and three (5GF147, 5GF742, and 5GF879) of the five sites are <br />located on Federal lands administered by the BLM. <br />The SHPO has concurred with the BLM that site 5GF741 will not be impacted <br />by the proposed project; that sites 5GF743, 5GF326, and 5GF879 are not <br />eligible for inclusion in the National Register of Historic Places and <br />therefore require no further work, and, finally, that sites 5GF1147 and <br />5GF742 are eligible for nomination to the NRHP. A mitigation plan for the <br />two eligible sites has been developed by the BLM and concurred with by the <br />SHPO on April 11, 1984. The applicant, as part of the special <br />stipulations attached to BLM Lease Agreement No. C-36791, has committed to <br />performing mitigation measures for archaeological sites 5GF1147 and 5GF742 <br />in accordance with the approved mitigation plan. Mitigation activities <br />will be performed prior to construction activity in the area and will be <br />coordinated by and through the BLM Grand Junction Resource Area <br />Archaeologist. A copy of the approved BLM Lease Agreement is included as <br />Appendix GS-11 within the amended permit application. <br />For this surface mining operation, private mineral estate has not been <br />severed from private surface estate; therefore, the documentation <br />specified by Rule 2.03.6(2) is not required (2.07.6(2>(f)). <br />On the basis of evidence submitted by the applicant and received from <br />other state and federal agencies as a result of the Section 34-33-114(3) <br />_12_ <br />
