a) An area designated unsuitable for surface coal mining operations <br />(2.07.6(2)(d)(i)); <br />b) An area under study for designation as unsuitable for surface coal <br />mining operations (2.07.6(2)(d)(ii)); <br />c) The boundaries of the National Park System, the National Wildlife <br />Refuge System, the National System of Trails, the National Wilderness <br />Preservation System, the Wild and Scenic Rivers System including <br />rivers under study for designation, and National Recreation Areas <br />(2.07.6(2)(d)(iii)(A)); <br />d) Three hundred feet of any public building, school, church, community <br />or institutional building, or public park (2.07.6(2)(d>(iii)(B)); <br />e) One hundred feet of a cemetery (2.07.6(2)(d)(iii)(C)>; <br />f) The boundaries of any National Forest unless the required finding of <br />compatibility has been made by the Secretary of the U.S. Department of <br />Agriculture (2.07.6(2)(d)(iii)(D)); <br />g) One hundred feet of the outside right-of-way line of any public road <br />except where mine access or haul roads join such line, and excepting <br />any roads for which the necessary approvals have been received, <br />notices published, public hearing opportunities provided, and written <br />findings made (2.07.6(2)(d>(iv)); <br />h) Three hundred feet of an occupied dwelling unless a written waiver <br />from the owner has been provided (2.07.6(2)(d)(v)). <br />The Division finds that all necessary notices and approvals have been <br />received in order to allow the permittee to adversely affect a public park <br />or place listed on or eligible for listing in the National Register of <br />Historic Places as determined by the State Historic Preservation Office. <br />The places to be affected are archaeological sites 5GF1147 and 5GF742 at <br />the mouth of Munger Canyon. Mitigation measures for these sites have been <br />stipulated as a part of BLM lease agreement No. C-36791. Approval to <br />affect it has been received from the Division, the Colorado State Historic <br />Preservation Office (SHPO>, and the Bureau of Land Management (BLM> <br />(2.07.6(2)(e)(ii)). <br />Information appropriate to cultural and historic resources can be found in <br />Section 4.1.5 of Volume 1, Appendix J of Volume V, and Section 4.1.4 of <br />Volume VI of the application. These sections have been reviewed by the <br />Division and the following comments result: <br />A number of cultural resource studies were prepared for Sait Creek Mininq <br />Company's McClave and Munger Canyon coal mine areas in Garfield County, <br />Colorado, as part of the permitting process for the initial permanent <br />regulatory program permit. Chief among the reports was a submission by <br />the Grand River Institute, 1980 and two survey reports by the Museum of <br />Western Colorado of work conducted in the area in 1977. The surveys <br />covered roads, drill hole locations, areas of potential surface <br />disturbance and a sample survey of areas that in the future may be <br />
