However, COM, INC. shall not be held liable for any accident <br />which might occur to said employee(s) or any visitors or agents of MI <br />VIDA, while on COM, INC.'s property. All such employees will be on <br />COM, INC.'s property at MI VIDA's risk at all times. <br />MI VIDA will hold COM, INC. harmless from any costs, liability, <br />damage, claim or expense occasioned by or attributable to the <br />presence of its agents or employees on COM, INC.'s property. <br />b. During the course of milling and processing MI VIDA ores, <br />COM, INC. shall maintain at all times running logs of milling oper- <br />ations and testing in the form attached as Exhibit D. The mill logs <br />shall be available to inspection and copying at all reasonable times by <br />MI VIDA. The mill logs shall be permanently maintained as part of the <br />Mill's records, on site, for a period of not less than three (3) years <br />after the completion of any covered mill run. However, records after <br />three (3) years will be turned over to MI VIDA. <br />c. During the running of MI VIDA ores, access to the Mill shall <br />be granted to MI VIDA's authorized employees for inspection of <br />processes and oversight as provided in this Agreement. In the event <br />MI VIDA's authorized representative or agent is anon-employee of MI <br />VIDA, MI VIDA shall provide to COM, INC. at COM, INC.'s request, <br />written evidence that the non-employee is covered by his own or his <br />employer's current workmen's compensation policy. <br />d. COM, INC. shall conduct routine sampling of heads, tails and <br />concentrates in accord with the mill log sheets. Daily splits of <br />sampled material shall be submitted for separate assay by a reputable <br />third party assayer; results shall be provided to MI VIDA as they <br />become available, and entered into the mill logs. <br />10. Conduct of Milling Operations <br />a. COM, INC. will mill the ores of MI VIDA in accord with the <br />standards and practices generally accepted and utilized in the milling <br />industry, and in accord with the milling specification sheet. <br />b. COM, INC. does not guarantee a specific percentage of <br />recovery of the precious metals content of the MI VIDA ore, but will <br />attempt, to the best of its ability and in accord with good industry <br />practice, to achieve the highest possible level of recovery, and to <br />adJust circuit operations accordingly. <br />10 <br />
