the Chronicle News once weekly for four consecutive weeks, beginning on May 19, <br />2005. Fourteen landowners within and adjacent to the mine permit azea were also <br />notified of the Divisions intent to terminate jurisdiction, as required by Section <br />3.03.2(1), as were the Huerfano County Commissioners and the Huerfano County <br />Planner. No comments were received from any of the parties notified. <br />Backfilling and Grading <br />All areas have been appropriately backfilled and graded to the approximate original <br />contour. All reasonably available spoil in the petmiY area was utilized. Backfilled <br />slopes are compatible with the post mining land use of rangeland. Edges of the <br />disturbed area blend well into the adjacent, undisturbed areas. One main purpose of <br />the Cooperative Agreement was to eliminate dangerous highwalls at the site. No <br />highwalls remain and no unreclaimed pits or depressions are present. This objective <br />has been achieved. Rills and gullies do not exist to the extent that the post mining <br />land use is compromised, which was another objective (correct severe erosion) ofthe <br />Cooperative Agreement. The requirements of Rule 4.14 have been met to the extent <br />applicable. <br />Topsoiling <br />All topsoil was redistributed at this site. No topsoil stockpiles remain. As <br />mentioned, one of the objectives of the Cooperative Agreement was to correct the <br />severe erosion problems at the site. Distribution of topsoil over the regraded areas <br />improves the chances for revegetation success over the bond liability period and <br />reduces the likelihood of continued erosion problems. Areas of exposed spoil and <br />overburden materials were not observed during the final field inspection, indicating <br />all areas received at least a minimal application of topsoil prior to reseeding. <br />Revegetation Success Standards <br />- Cover Standard: <br />- Production Standazd: <br />- Woody Stem Density <br />23% <br />2371bs/acre (26.6 g/mZ) <br />No standard applies <br />The cover standard is 23 percent, to ensure the fulfillment of the Rule 4.15.10 <br />requirements. The cover and production were set using the baseline data. <br />Based upon the location of the mine-site and the post-mining land use of <br />rangeland, the Division has determined the diversity standazd for the New <br />Pryor Mine site to be "at least three perennial grass species, each contributing <br />at least 3%, but not greater than 60% relative cover. At least one of these <br />species will be a warm season grass and at least one shall be a cool season <br />grass." <br />The reclaimed area was quantitatively sampled in 2002 and 2003 by Division staffto <br />7 <br />
