mobilization of equipment, coal spoil removal and placement followed by <br />overburden removal and placement to eliminate highwalls. Topsoil replacement <br />preceded seeding of the site. Improvements were also proposed to the permanent <br />sediment ponds. This Cooperative Agreement was closed out as documented in <br />Division correspondence dated 7/9/1992. <br />Inspection History <br />The New Pryor site was inspected on a monthly basis from the completion of <br />reclamation work done under the cooperative agreement in 1992 until the Spring <br />of 1998. At that time, the Division reduced the inspection frequency to two <br />inspections a year, one being a complete inspection as allowed by Rule 5.02.2(8). <br />All written inspections are part of the document record at the site. Other than a <br />small settlement area that developed in the west-central portion of the reclaimed <br />area, nothing of significance was noted or observed during the revegetation <br />liability period. The Inactive Mines Program repaired the subsidence feature in <br />the same season as it occurred. <br />III. CRITERIA AND SCHEDULE FOR BOND RELEASE <br />PHASE I <br />Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be <br />released when the permittee successfully completes backfilling, regrading, and drainage <br />control in accordance with the approved reclamation plan." The reclamation plan for <br />this mine site was designed and implemented under a cooperative agreement <br />(GR090081) with the Office of Surface Mining and Enforcement. As stated in Article <br />III, Section 2, Purpose, reclamation activities were intended to eliminate the dangerous <br />highwall and correct the severe erosion and failing vegetation at the site. The <br />agreement also states "the recipient is not responsible for further reclamation beyond <br />the maintenance performed during the first yeaz following completion ofthe Project." <br />PHASE li <br />Rule 3.03.1(2)(b) states, "Up to eighty-five percent of the applicable bond amount shall <br />be released upon the establishment of vegetation which supports the approved post- <br />mining land use and which meets the approved success standazd for cover... based on <br />statistically valid data collected during a single yeaz of the liability period". In regazd to <br />Phase II bond release, Rule 3.03.2(3)(b) also states, " No more than sixty (60) percent <br />of the bond shall be released so long as the lands to which the release would be <br />applicable are contributing suspended solids to stream flow or runoffoutside the pemut <br />area in excess of premising levels as determined by baseline data or in excess of levels <br />determined on adjacent non-mined azeas". With regard to Phase II bond release, the <br />reclamation plan conducted under the cooperative agreement included topsoil removal <br />5 <br />
