Lands included in the Termination of Jurisdiction Process <br />A total of 22 acres were disturbed at the New Pryor Mine within a permit area of 138 <br />acres. This TOJ written finding is for all 138 acres of the permit azea. <br />Dollar Amount of Bond to be Released <br />The New Pryor mine is abond-revoked site. No bond money exists for release nor is <br />the former permittee due any monetary consideration of any kind as a result of this <br />TOJ process. <br />II. BACKGROUND AND HISTORY OF THE NEW PRYOR MINE <br />Initial Permitting History <br />Viking Coal Company (VCC) first proposed the New Pryoi Strip Mine in a <br />permanent program permit application. Included in this application was mining in an <br />area called "Old Pryor" and a large, undisturbed, adjacent area in Section 24. <br />Overwhelming inadequacies in the application identified by the Division led VCC to <br />scale down the scope of the application to the currently existing permit area. The <br />New Pryor permit was brought to fruition by VCC. The permit was issued effective <br />November 9, 1982 and a bond was submitted. <br />On August 10, 1983, a transfer application was received from VCC to American <br />Fuels, Inc. The transfer was approved on September 22, 1983 and a replacement <br />bond was submitted. Operations commenced shortly after and continued in <br />compliance with the Rules for coal mining for approximately one year. <br />Permitting Revocation and Bond Forfeiture <br />In late 1984, the operation went into temporary cessation. Numerous Notices of <br />Violation followed and a Show Cause Order was issued on May 3, 1985. A Mined <br />Land Reclamation Boazd (Board) hearing was held on July 25, 1985 and the permit <br />was suspended for 30 days, with a continuation at the next Boazd hearing to <br />determine whether the permit should be further suspended or revoked. On August <br />22, 1985, the permit was again suspended for 30 days and reclamation bond # <br />0097278 issued by Union Indemnity Insurance Company was declared forfeited by <br />the Mined Land Reclamation Board (Board) in the amount of $58,073.00 on <br />September 20, 1985 nunc fro tunc (now for then) August 22, 1985.
