C~ <br />• <br />Section III - Status of Stipulations <br />(continued) <br />Stipulation No. 4 <br />The operator shall install and begin monitoring one monitoring well <br />located over the panel to be monitored for subsidence one year prior to <br />mining this panel. The hole shall be completed in the stratum overlying <br />the "D" seam. Water levels in this well shall be drawn twice per year for <br />the parameters listed in Appendix A of this Findings Document. The <br />operator shall submit to the Division a well completion report, monitoring <br />schedule, groundwater level data and water quality data prior to mining <br />this panel. <br />Resolved: CWI drilled DH-58 on December 10, 1982 and submitted a <br />completion report on February 4, 1983. This well never yielded water and <br />was removed from the hydrologic monitoring program in the 1986 permit <br />revision. Drill hole 70 currently intercepts the stratum overlying the <br />"D" seam. <br />Stipulation No. 5 <br />The Division directs Colorado Westmoreland, Inc. to submit reports of its <br />subsidence monitoring program on a semi-annual basis, commencing one month <br />after the installation and initial surveying of the subsidence monuments. <br />Further, due to the complexity of the permit area geology, presence of <br />steep slopes, and sensitive hydrologic elements, Colorado Westmoreland, <br />Inc. is directed to submit a proposed subsidence monitoring report format <br />to the Division for approval. This report format should recognize the <br />importance of continual update of subsidence data interpretation, <br />monitoring of groundwater levels and spring flow, monitoring of mine <br />inflow, and subsurface ground conditions which could be correlated to <br />subsidence prediction. This report format shall be approved by the <br />Division prior to the commencement of extraction of coal within the <br />5 north panel off the 8th east main of the Orchard Valley Mine. <br />Resolution: Reporting format was received May 14, 1982. The first report <br />was received August 15, 1983 and accepted August 30, 1983. CWI committed <br />to semi-annual submittal of subsidence report monitoring in the permit <br />document. Subsidence monitoring and reporting frequency was reduced to <br />annual requirements by the approval of Technical Revision No. 6 on <br />January 28, 1989. COVCC committed to these monitoring requirements in <br />Section 2.05.6(6)(c)<i)(B) of the permit document. <br />-6- <br />
