I. PROCEDURES AND SUMMARY OF THE REVIEW PROCESS <br />P&M applied for a Phase I bond release under the Colorado Surface Coal Mining and <br />Reclamation Act following reclamation of the Moffat Area of the Edna Mine. The azea <br />requested for release covers 342.5 acres and is located in Routt County, 5 miles northwest <br />of Oak Creek. The lands requested for release lay within the following legal descriptions: <br />Section 31, TSN, R85W <br />S'/z, N %z <br />S '/z <br />Section 7, T4N, R85W <br />N%z,N%z <br />SE 1/4, NW 1/4 <br />S''/z, NE I/4 <br />Section 36, TSN, R 85 W <br />E''/z, SE 1/4 <br />The Moffat Area was mined and reclaimed under the Colorado Surface Coal Mining <br />Reclamation Act (Act). <br />P&M applied for the Moffat Area Phase I bond release on October 15, 1997. The <br />application was deemed complete on February 9, 1998 after the Division received proof <br />of publication of the applicant's public notice. P&M published notice of the bond release <br />application for four consecutive weeks in the Steamboat Pilot from October 29, 1997 <br />through November 19, 1997. P&M also notified various government agencies and the <br />land owners within and adjacent to the release area of the bond release application as <br />required by Section 3.03.2(1). <br />No written objections or requests for an informal conference regarding the bond release <br />application were received by the Division. <br />The Division scheduled and conducted a bond release inspection on July 21, 1998. The <br />site inspection was conducted in accordance with Rule 3.03.2(2). Landowners of the <br />release azea and the Office of Surface Mining were notified of the inspection. <br />Representatives from OSM and P&M were present during the inspection. The US <br />Bureau of Land Management notified the Division by telephone that they probably would <br />not participate in the inspection.
