-63- <br />On-going: <br />Node 22 (B-7) was drilled 10/30/81 and the well completion report was <br />submitted 12/11/81. Results from this site are currently submitted on an <br />annual basis. This stipulation is currently found as Stipulation No. 32 <br />in the 1988 document. <br />STIPULATION N0. 7 <br />WITHIN 60 DAYS OF PERMIT ISSUANCE, COLORADO WESTMORELAND, INC. MUST <br />PROVIDE THE DIVISION WITH A SPECIFIC CROP PRODUCTION STANDARD FOR THE <br />ORCHARD AREA. PENDING DIVISION APPROVAL, THIS STANDARD WILL BE USED IN <br />EVALUATING REVEGETATION SUCCESS WITHIN THE ORCHARD VEGETATION TYPE. <br />Resolved: <br />CWI submitted the final plan for evaluating orchard revegetation success <br />on 3/2/82. This was approved by the Division on 3/31/82. <br />STIPULATION N0. 8 <br />WITHIN 60 DAYS OF PERMIT ISSUANCE, COLORADO WESTMORELAND, INC. MUST <br />PROVIDE THE DIVISION WITH AN APPROPRIATE, JUSTIFIABLE SHRUB/TREE DENSITY <br />STANDARD WHICH WILL BE SUFFICIENT TO MEET THE APPROVED POST-MINING LAND <br />USE FOR THE RECLAIMED SURFACE. THIS STANDARD MUST BE BASED UPON A <br />RECOMMENDATION FROM THE DIVISION OF WILDLIFE, AND MUST INCLUDE THE <br />FINDINGS OF THE TECHNICAL REFERENCES/SOURCES USED TO ESTABLISH THIS <br />STANDARD. <br />Resolved: <br />CWI submitted a shrub/tree density standard to the Division on 3/2/82. <br />The Division approved it on 3/31/82, It can be found in Volume 9A of the <br />current permit application. <br />STIPULATION N0. 9 <br />THE OPERATOR'S QUARTERLY SURFACE WATER MONITORING REPORTS SHALL INCLUDE <br />THE WATER QUALITY TESTING PARAMETERS LISTED IN APPENDIX A, BASELINE WATER <br />QUALITY MONITORING. <br />Resolved: <br />CWI incorporated the Division's Baseline Data Collection Guidelines into <br />Volume 4, Table 6 of their permit application. The testing parameters <br />listed in Appendix A have been included in the surface water monitoring. <br />STIPULATION N0. 10 <br />ALL SPRINGS IN THE 5-YEAR PERMIT AREA AND ADJACENT AREA (THOSE IN 'I <br />SECTIONS 18 AND 19, T13S, R91W, AND SECTION 24, T13S, R92W) SHALL BE ~, <br />MONITORED FOR DISCHARGE AND WATER QUALITY (I .E. pH, ELECTRO-CONDUCTIVITY <br />AND TEMPERATURE) ON A QUARTERLY BASIS AS WEATHER PERMITS. THE DATA <br />GATHERED FROM THE MONITORING SHALL BE SUBMITTED TO THE DIVISION QUARTERLY. <br />
