-49- <br />Stipulation No. 34 <br />MINIMIZATION OF WILDLIFE DISTURBANCE ON THE LIGHT USE ROAD WHICH RUNS <br />BETWEEN OVWM AND THE VENTILATION SHAFT/WATER STORAGE TANK BENCH WILL BE <br />ACCOMPLISHED BY: <br />A) CLOSING ROAD TO PUBLIC USE: <br />B) LIMITING TRAVEL FOR ROUTINE MAINTENANCE ACTIVITIES TO <br />BETWEEN 10 AM AND 2 PM DURING DECEMBER, JANUARY, MARCH <br />AND APRIL WHEN BIG GAME ANIMALS ARE PRESENT. <br />All concerns relating to fish and wildlife which were raised by the Division <br />and D.O.W. have been resolved, and the proposed operation is in compliance. <br />XIII. PRIME FARMLAND (2.04.12, 2.06.6, 4.25) <br />Information pertaining to prime farmland may be found on pages 88 and 89 of <br />Section 2,04 and in the Prime Farmland Appendix of Volume 9A. <br />The Division has previously made a negative determination pertaining to the <br />presence of prime farmland at this site. The basis of this determination has <br />been letters from the Soil Conservation Society specifying there are no prime <br />farmland mapping units within the permit area. <br />The Division has not received aRy information causing a change to this <br />previous determination. Therefore, the Division reaffirms a negative <br />determination pertaining to the presence of prime farmland within the permit <br />area. <br />The operation is in compliance with the requirements of this section. <br />XIV. OPERATIONS DESCRIPTION (2.05.2, 2.05.3(1), 2.05.3(2), 4.01) <br />The operations plan for the Orchard Valley mine is presented on pages 1-57, <br />Section 2.05 of the application. The mine planning appendix is found in <br />Volume 2. Stability analyses are documented in Yolumes 6 and 6A, and haul <br />road documentation is located in Volume 8. <br />Orchard Valley is mined in a room and pillar arrangement utilizing continuous <br />miners. The mine plan calls for eventual pillar recovery throughout the mine <br />except in BLM buffer zones below creeks and alluvial-colluvial deposits and <br />below impoundments with water rights that are underlain by less than 800 feet <br />of overburden. CWI estimates that there are over 37 million tons to <br />recoverable reserves, and 8.3 million have been mined to date. The current <br />mine plan shows the extraction of 300,000 - 500,000 tons per year for the next <br />five years. <br />The information presented was sufficient to satisfy the requirements of this <br />section. All concerns pertaining to the operations description have been <br />resolved and the proposed operation is in compliance. <br />
