Doerfer <br />RE: STATUS OF TBM <br />As you requested, I have prepared this memo which describes the status of the <br />Trinidad Basin Mine (TBM) permitting activity at the time of transfer of this <br />mine over to your team. .Hopefully, the description provided below will assist <br />you and team members. <br />General <br />TBM is currently under a board-ordered suspension from mining coal and <br />as such, the activity occurring at present on-site is restricted to <br />reclamation of previously disturbed areas. There are sections on the <br />site which are "pre-law" and the extent of TBM's required commitments <br />to reclamation have been met. A highwall area northwest of the shop <br />was backfilled to a point half way up the slope on a voluntary basis by <br />Vance Mills, the current permittee. These efforts were taken into <br />consideration by the Board during the formal hearing of <br />November 25, 1985 and were substituted as partial payment for <br />delinquent civil penalties racked up from a whole slew of violations <br />during 1984. <br />The Board decision included a requirement to reclaim the loadouts, one <br />in the City of Trinidad and the other located near Ludlow, in a timely <br />fashion, These activities were completed this summer, including <br />removing the sediment ponds. As the post-mining land use for these <br />areas is industrial, no revegetation was performed. You may want to <br />request a sign-off be provided by the railroads from the operator that <br />the work done was satisfactory. <br />The most recent permitting activity has been Phase I Bond Release. As <br />all of the mafor backfilling and grading work has been performed, <br />Greg Lewicki of Panorama Resource Services, Inc., TBM's total <br />permitting coordinator, initiated the process last fall. The Division <br />requested a correct total bond amount be published and map be submitted <br />which was keyed to the cross-sections provided in order to have a <br />complete request. By the time this was done the Division could not do <br />the bond release inspection because of snow cover.
