Coal will be removed from the mine by continuous miner and conveyor equipment <br />and will be crushed and sized at the surface for transport to consumers. <br />No washing or processing other than crushing is planned for the mine. <br />The operation plans to extract an average of 250,000 tons of coal yearly <br />during this permit term, and approximately 2,500,000 tons during the projected <br />1 i fe of the mine. <br />The proposed operation is in compliance with the requirements of this section. <br />XVI. Explosives - Rule 2.05.3 (6 <br />The applicant does not propose any surface blasting (page 2.05-19) since <br />mining operations are to be conducted underground. Therefore, the Division <br />specifically does not approve any above-ground blasting activities during this <br />permit term. <br />The proposed operation is in compliance with the requirements of this section. <br />XVII. Backfilling and Grading - Rules 2.05.3 (3), 2.05.3 (4), 2.05.4 (2) (a <br />2.05.4 (2) (c). 4.09. 4.13, and 4.14 <br />The applicant has provided information on backfilling and grading in <br />Sections 2.05.3 and 2.05.4 of the application. <br />The applicant has proposed to reduce the highwalls along the facilities area <br />while leaving a portion of the overburden material stockpiled at the southeast <br />corner of the permit area. The general backfilling and grading plan as <br />presented is sufficient to meet the approximate original contour requirements, <br />and sufficient to reduce erosion, thereby minimizing impacts to the surface <br />hydrologic regime. However, the Division requires more clarification on the <br />backfilling and grading plan, and post-mining topography. It is therefore <br />stipulated: <br />Stipulation No. 7 <br />WITHIN SIXTY (60) DAYS OF PERMIT ISSUANCE, THE PERMITTEE WILL SUBMIT <br />DETAILED DESIGNS FOR BACK FILLING AND GRADING. THESE SHALL ADDRESS <br />REPLACEMENT OF THE EXISTING OVERBURDEN AT THE SOUTHEAST CORNER OF THE <br />PERMIT AREA ALONG THE HIGHWALL WITHIN THE FACILITIES AREA. ALL SLOPES <br />WITHIN THE DISTURBED AREA SHALL BE NO STEEPER THAN 3V:1H. THE PLAN <br />SHALL ADDRESS HOW THE POST-MINING CONFIGURATION MEETS THE REQUIREMENTS <br />OF APPROXIMATE ORIGINAL CONTOUR, AND BLENDS WITH THE SURROUNDING <br />TOPOGRAPHY. THE PERMITTEE WILL SUPPLY CROSS-SECTIONS OF THE PROPOSED <br />POST-MINING TOPOGRAPHY ON 200 FOOT CENTERS THROUGH THE DISTURBED AREA. <br />THE PERMITTEE SHALL ALSO PROVIDE A REVISED POST-MINING TOPOGRAPHY MAP <br />WITH MAXIMUM FIVE-FOOT CONTOUR INTERVALS. THE REQUIREMENTS OF THIS <br />STIPULATION WILL BE SATISFIED ONLY UPON WRITTEN APPROVAL BY THE DIVISION <br />TO THAT EFFECT. <br />With the acceptance of the above stipulation, the proposed operation is in <br />compliance with the requirements of this section. <br />
