Stipulation No. 5
1. THE PERMITTEE SHALL CONSTRUCT A DITCH TO INTERCEPT DRAINAGE ABOVE THE
PLANT GROWTH MEDIUM STOCKPILES ADJACENT TO THE HIGHWALL/SLOPE AREAS.
ALONG THE PERIMETER OF THE STOCKPILES A CONTAINMENT DITCH SHALL BE
CONSTRUCTED.
2. THE PLANT GROWTH MEDIUM STOCKPILES SHALL BE SEEDED WITH THE APPROVED
RECLAMATION SEED MIX, MINUS WOODY PLANT SEEDS, AND MULCHED WITH STRAW OR
NATIVE HAY AT 4,000 POUNDS/ACRE DURING THE FIRST APPROVED
SEEDING/PLANTING SEASON AFTER PERMIT ISSUANCE.
With the acceptance of these stipulations, the proposed operation is in
compliance with the requirements of this section.
XII. Vegetation - Rules 2.04.10, 2.05.4(2)(e), 4.15, and 4.18.4(1)
The applicant has submitted baseline vegetation information in Section
2.04.10, and the revegetation plan in Section 2.05.4 and 4.15.
The area proposed to be disturbed by surface coal mining operations has been
previously disturbed by coal mining operations and not reclaimed to the
requirements of SMCRA or the Colorado Surface Coal Mining Reclamation Act.
The applicant has provided baseline vegetation information drawn from SCS
personnel and on-site investigations of undisturbed adjacent areas. Based on
this information the Division has extrapolated that three vegetation
communities originally were present in the area now disturbed.
These communities would have been: a mixed mountain shrub-conifer community
on the northeast facing slopes of the Coal Gulch drainage, a
pinyon-juniper-mountain shrub community on the southwest facing slopes of Coal
Gulch, and a dry grassland type found on the colluvial toeslopes and at the
mouth of Coal Gulch.
The aspects of the proposed reclamation plan for the Coal Gulch Mine are
specified in Table 1 below.
