Rule 4.16 <br />28. The post-mining land use at the reclaimed loadout is currently rangeland and <br />wildlife habitat. Over the last year the primary landowner at the loadout, the <br />Atchison Topeka and Santa Fe Railroad, has been using the area to store railcars <br />and other miscellaneous items. In doing so, they have dumped a significant <br />quantity of rock onto the tracks and surrounding areas. It is the belief of the <br />Division [hat this is not consistent with the approved post-mining land use. Please <br />provide your reasoning as to why this is consistent with the post-mining land use <br />or propose a change to said use that is more consistent with its current and <br />intended use. <br />Please let me know if you have any questions regarding this letter or the aforementioned <br />2002 Midterm Review. <br />Sincerely, <br />James R.
