The <br />numbering is a continuation of the numbering from Section V -Decision to Require <br />Revisions, which ended with item number Z5. <br />D 7 V! Long <br />Division Director <br />Rule 4.05.5 <br />26. Although Pond 3 is a freshwater pond and is not included in the sediment control <br />system, it will be necessary for EFCI to submit a plan on controlling runoff and <br />sedimentation from the area of Pond 3 after it is backfilled. Backfilling and <br />regrading of the pond should not commence until the plan has been approved by <br />the Division. If the area will be considered a small area exemption (SAE), please <br />provide the appropriate SEDCAD documentation and maps. <br />Rule 4.10 <br />27. Since EFCI has completed covering the refuse pile, please provide the Division <br />with a plan for the disposal of the remaining coal fines piles in the facilities area. <br />Please include a plan for disposing of the soil that has been contaminated by the <br />coal stockpiles in the facilities area. This plan should be approved prior to any <br />backfilling operations that would be commenced in this area. <br />
