The disposal area will be inspected on a regular basis by a qualified pro- <br />fessional specialist under the direction of the professional engineer, <br />experienced in construction of similar earth and waste structures. Inspection <br />by this person has been approved by the Division as appropriate 14.10.211 )). <br />VI. Backfilling and Grading <br />A. The Division has approved the applicant's plan for aone-time disposal of non- <br />toxic, non-coal debris in a manner designed to prevent contamination of <br />ground or surface waters. A contingency plan has also been developed to <br />prevent sustained combustion of flammable materials (4.14.3(1)(a)). <br />VII. Revegetation <br />A. The Division has done an initial review of the permittee's revegetation plans. <br />Further analysis is needed, so this requirement is being added to Stipulation <br />No. 71. <br />Stipulation No. 71 <br />THE PERMITTEE WILL SUBMIT TO THE DIVISION BY APRIL 21, 1994 A <br />COMPREHENSIVE TECHNICAL REVISION WHICH ADEQUATELY <br />ADDRESSES: <br />1. APPROPRIATE TOPSOIL REPLACEMENT REQUIREMENTS AND AN <br />ADEQUATE TOPSOIL MASS BALANCE ANALYSIS;. <br />2. MORE APPROPRIATE REVEGETATION SUCCESS STANDARDS, <br />BETTER DEFINED VEGETATION SAMPLING METHODOLOGY, <br />AND MORE APPROPRIATE REVEGETATION SEED MIXES. <br />VIII. Subsidence Control <br />A. The Division has reviewed the subsidence information submitted by the <br />permittee. Because the angle of draw cannot be calculated from the <br />subsidence monitoring data from the NW-1 longwall panel, the Division cannot <br />concur with the permittee that the worst possible consequences of subsidence <br />will not cause material damage or diminution of reasonable foreseeable use. <br />Therefore, Stipulation Nos. 66, 68, 69, and 70 are required. <br />Stipulation No. 66 <br />THE PERMITTEE SHALL SUBMIT TO THE DIVISION BY FEBRUARY 21, 1994 <br />A REVISED INVENTORY, PURSUANT TO RULE 2.05.6(6)la), AND A REVISED <br />MAP, PURSUANT TO RULE 2.05.61611a)Iii1lB1, OF THE MAN-MADE <br />STRUCTURES NOT INCLUDED TO DATE ON THE CURRENTLY SUBMITTED <br />MAP AND INVENTORY. <br />13 <br />
