B. Sedimentation Ponds <br />All five sedimentation ponds at the Chimney Rock Mine have been removed and reclaimed in <br />accordance with the approved reclamation plan upon the Division's approval of the Phase II bond <br />release application in July 1997. <br />C. Acid-forming and Toxic-forming Spoil <br />The operator has performed both chemical analyses and leaching studies on samples of the <br />overburden, interburden and coal strata. Based on these analyses, the Division has determined that <br />there is no problem with acid-forming materials or toxic metals at the site. The overburden may <br />affect the salinity and alkalinity of surface waters and ground waters. These effects are expected to <br />be negligible. <br />Details of the chemical characteristics of the overburden, interburden, and coal, as well as greater <br />detail on the geology of the area, can be found in Sections 2.04.5 and 2.04.6 in Volume I of the <br />approved permit application. All spoil was buried in accordance with the mine plan after it was first <br />exposed on the mine site (4.05.8(3)). <br />D. Impoundments <br />All impoundments (five sedimentation ponds) have been reclaimed. <br />E. Surface and Ground Water Monitoring <br />The termination of ground water monitoring was discontinued with the approval of <br />Technical Revision 32 (4.05.13(1)). <br />2. All surface water monitoring was discontinued with the approval of Technical Revision <br />30, after the Division had made the determination that pond removal would not <br />negatively impact the hydrologic balance (4.05.13(2)). <br />F. Transfer of Wells <br />The Division approved transfer of a monitoring well located in the SE '/< of Section 30, T 34 N, R 4 <br />W, N.M.P.M. This transfer was based on the fact that a well permit was obtained from the State <br />Engineer, and written requests for the transfer were received from the applicant and the surface <br />owner. At the fmal decision of the recent Phase III bond release, the well was formally transferred <br />over to the landowner (4.05.14(3)). <br />G. Dischazge of Water into an Underground Mine <br />No discharge of surface water into an underground mine opening occurs presently nor during the <br />operation of the Chimney Rock Mine in years past.
