15. The Division finds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the destruction or adverse <br />modification of their critical habitats (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br />March 13, 1998, the operator is current in the payment of reclamation fees required by 30 CFR <br />Chapter VII, subchapter R (2.07.6(2)(0)). <br />Section B -Rule 4{tc \12 "Section B -Rule 4} <br />I. Roads -Rule 4.03{tc \13 "I. Roads -Rule 4.03} <br />A. Haul Roads <br />The Division has approved the retention of a portion of the haul road depicted on Map No. 8 since it <br />is compatible with the approved post-mining land use, and a request for its retention was submitted <br />by the landowner (4.03.1(1)(f)(I)). <br />B. Access Roads <br />The landowner has requested the retention of the access road depicted on Map No. 8. Its retention is <br />compatible with the approved post-mining land use of pasture land. Therefore the Division has <br />approved retention of the access road (4.03.2(1)0). <br />II. Support Facilities -Rule 4.04{tc \13 "II. Support Facilities -Rule 4.04} <br />A. With the exception of the facilities that were requested by the landowner to remain at the <br />conclusion of mining; two maintenance buildings, two trailer houses, and portions of access and haul <br />roads, all support facilities were removed from the site. Accordingly no specific findings regazding <br />support facilities aze required. <br />III. Hydrologic Balance -Rule 4.05{tc \13 "III. Hydrologic Balance -Rule 4.05} <br />A. Water Quality Standards and Effluent Limitations <br />The applicant has demonstrated those sediment ponds and/or treatment facilities were no longer <br />necessary for drainage to meet the effluent limitations of 4.05.2 and the applicable State and Federal <br />water quality requirements for downstream receiving waters. Therefore, the Division approved <br />removal of all sedimentation ponds in July 1997.On November 4, 1997, the Colorado Department of <br />Health approved termination of the Mine's NPDES Permit since there were no longer any point <br />source dischazges. (4.05.2(3)(a)). <br />
