Proposed Decision <br />The Division of Minerals and Geology proposes to approve with <br />conditions an application for renewal of a valid existing permit. <br />The application was submitted by Energy Fuels Coal, Inc. for the <br />Southfield Mine. This decision is based on a finding that the <br />operations will comply with all requirements of the Colorado State <br />Program as found in the Colorado Surface Coal Mining Reclamation <br />Act, C.R.S. 34-33-101 et seq., and the Regulations promulgated <br />pursuant to the Act. If no request for a formal hearing is made <br />within thirty days of the first publication of the issuance of this <br />proposed decision, then this decision becomes final. The permit <br />application, all supporting documentation and any stipulations or <br />conditions will become a binding part of the permit. <br />Summary of Stipulations <br />STIPULATION NO. 1 <br />THE OPERATOR SHALL SUBMIT RIGHT OF ENTRY INFORMATION FOR THE <br />FLORENCE CITY, A.T. MASSEY, AND CORLEY PROPERTIES, WHERE SUBSIDENCE <br />IS PROPOSED, 30 DAYS PRIOR TO AFFECTING THESE LANDS. <br />Status - Terminated <br />This stipulation was terminated with the issuance of the decision <br />for Permit Revision 1, March 11, 1991. Stipulation 12 was issued <br />at that time to cover additional required right of entry <br />information. <br />STIPULATION NO. 2 <br />THE OPERATOR SHALL CONTINUE ALL HYDROLOGIC MONITORING OUTLINED IN <br />THE APPLICATION AND THIS FINDINGS DOCUMENT UNTIL SUCH TIME AS THE <br />DIVISION APPROVES OF MODIFICATION OR CANCELLATION OF THE PROGRAM. <br />Southfield Mine Permit Renewal 03 <br />2 <br />
