Division proposes to approve the use of such structures. (4.05.04(4)(b)). C. Sediment Ponds As described in Section III. A. above, there are a total of five ponds at t:he mine site and two at the loadout. Ponds 1, 4 and 5 are used to settle sediment at the mine site, while ponds L-1 and L-2 are used to settle sediment at the loadout. Ponds 2 and 3 are part of a closed-loop recyclable system for water storage and use in the coal processing plant. Pond 3 is a fresh water storage pond, receiving water pumped from the Corley well while Pond 2 is primarily used as a water treatment and recyclable water source for the coal processing plant. All sedimentation ponds have been designed utilizing standard engineering practices to retain the run-off from a 10-year 24- hour storm event. Pond design criteria can be found in Exhibit 19 of the permit application. From the 1993 Mid-term Review, the following stipulation was added to update the pond as-builts: Stipulation No.22 THE OPERATOR WILL SUBMIT TO THE DIVISION BY JANUARY 31, 1994, UPDATES TO ALL POND AS-BUILTS THAT INCLUDE ALL RECENT IMPROVEMENTS ON PONDS 1,2,3,4,5 AND LOADOUT PONDS L-1 AND L-2. Updated maps were received by the due date and are now included in the permit application on Maps 24, 26 and 27. Ponds 2 and 3 are lined with a geo-textile mat while ponds 1, 4 and 5 are incised into the ground. Ponds 1, 4 and 5 all have primary and emergency spillways while ponds 2 and 3 do not, as they are part of a water storage system. Pond 3 has an underdrain that is gravity driven to supply water to Pond 2, where it is then used in the preparation plant. Pond 2 has a discharge outlet and is NPDES point 003. Ponds 1,4 and 5 are also NPDES discharge points.
