"REVISED" <br />Dear Dan: <br />The purpose of this letter is to provide a relevant showing that the herein mentioned travelways <br />that meet the DMG's definition of Road, as described in Section 1.04(111), meet the performance <br />standards of 4.03.1 and 4.03.2. <br />Evidence will not be presented for improvement work on Rio Blanco County Road 65 as it is and <br />always has been a pubfic road since the issuance of this permit and consequently is specifically <br />excluded from the DMG's definition of "Road" as described in Section 1.04, definition (111). <br />Refuse Haul Road <br />The Refuse Haul Road was designed before Colorado gained primacy for surface inspection and <br />therefore the original design and referenced standazds are from 30 CFR part 817. The referenced <br />standards have also been re-numbered since that time. To move forward in time to the present, <br />the appropriate Federal standazds appear now to be 30 CFR 817.150 and 817.151. The <br />cottesponding CMLRB standard is 4.03.1. <br />Through research of the design drawings, verbiage in the Permit documents, maintenance history <br />and visual inspection the refuse haul road appears to substantial comphance the provisions of <br />Rule 4.03.1. <br />More specifically the design, location, width and visible surface construction features were all <br />considered for the use of two 35 ton dump bed haul trucks or trucks of similar design.
